An uncontested divorce is the fastest route when spouses agree on all consequences of divorce (financial arrangements and—if applicable—child-related matters). The judge must hear the spouses in person, be satisfied that consent is free, and approve the settlement protocol; the judge may request changes especially to protect the child’s best interests.
A minimum one-year marriage duration from the official marriage date is a commonly emphasized legal requirement in practice.
This typically includes:
Financial consequences (maintenance/alimony, compensation, and clear intent on asset-related arrangements)
If there is a child: custody, visitation/personal contact schedule, child support
These are usually written into a signed divorce protocol.
The judge listens to both spouses personally, checks free will, and reviews the protocol; if the judge finds child-related terms not in the child’s best interests, adjustments may be required.
Case screening (eligibility + full agreement check)
Drafting the divorce protocol (clear, future-proof terms)
Petition + attachments (protocol is filed with the petition)
Filing at the competent court (Family Court; jurisdiction based on residence/last 6 months living together is commonly referenced)
Hearing (confirmation of consent + protocol review)
Finalization and civil registry steps
➔ Divorce petition
➔ Signed uncontested divorce protocol
➔ ID copies
➔ Civil registry extracts / marriage records (practice-driven)
➔ If a child exists: child arrangements clearly set in the protocol
Current practice commonly states that mediation is not mandatory for the divorce itself in Turkey, although parties may use mediation/negotiation support voluntarily.
