How many days before the 2-year deadline should I apply?
We recommend applying at least 3-6 months before. Document collection, appraisal and application processes take time. Last-minute applications may face issues.
Are there situations that stop the statute of limitations?
In case of injury, the limitation period may extend to criminal statute of limitations (8-15 years). Written negotiations with insurance company may also pause the deadline.
When should the expert report be obtained?
Ideally obtained before or right after repair. Reports obtained long after repair may be weak as evidence.
How is the accident date determined?
The date on the accident report is used. If no report exists, documents like insurance notification or hospital records can be used.
Can I apply after 2 years have passed?
Unfortunately no. The 2-year statute of limitations is absolute and you cannot claim rights after it expires. This is why acting early is critically important.
