Under Article 67 of the Enforcement and Bankruptcy Law, this action seeks to continue non-judgment enforcement stayed by the debtor’s objection. It is not an appeal against a court judgment. The creditor must establish the underlying debt under the general rules of evidence.
The action must be brought within one year after notification of the objection to the creditor. This differs from the debtor’s deadline to object to a payment order and the period for summary removal of an objection. Subject-matter jurisdiction follows the underlying legal relationship; the enforcement court is not the proper court in every case. Mandatory mediation and its effect on time limits must be considered where applicable.
The enforcement file, payment order, service records, objection, contract, invoices, delivery documents and payment records should be examined together. The connection between the debt pursued in enforcement and the claim in court must be preserved. Characterising an objection as unjustified does not establish the debt.
A successful action may permit enforcement to continue for the accepted amount. Compensation for an unjustified objection is not automatic: a request and the relevant legal conditions must be established. Expiry of the one-year period does not invariably extinguish the debt; an ordinary debt claim and the applicable limitation period require separate analysis.
