What is a Detention Appeal?
A detention appeal is a legal application where a detained person claims that the order is unlawful or that the grounds for detention no longer exist, seeking release or a lighter protective measure.

Appeal Process
Under the general objection rule in CCP art. 268, an objection to detention may as a rule be filed within two weeks of becoming aware of the decision. It applies to decisions issued on or after 1 June 2024. Transitional provisions may apply to earlier decisions. The file is then sent to the competent review authority; timing depends on the court's workload and the complexity of the file. If the objection succeeds, release or a lighter protective measure may be ordered.
