Frequently Asked Questions

How is the good-conduct reduction (PC art. 62) applied?

Considering the defendant's background, social ties and conduct after the act and during trial, the court may apply a discretionary reduction of up to one-sixth (Penal Code art. 62). The decision must rest on concrete reasons; mechanical application is unlawful. The outcome depends on the specific evidence and the court's assessment; consult an attorney for your individual situation.

In which offences does effective remorse reduce the penalty?

Special effective-remorse provisions exist for theft, robbery, fraud, breach of trust, embezzlement, extortion, bribery, drug offences and organisational membership (Penal Code arts. 168, 184, 192, 221, 248, 254). Conditions like compensating the harm or helping dissolve an organisation can cut the penalty in half or more. The outcome depends on the specific evidence and the court's assessment; consult an attorney for your individual situation.
